These Terms apply primarily to importers, distributors, wholesalers, retailers, and other business partners (“you”, “your”).

 
1. Scope of Services
Anagh Foods operates as a business-to-business sourcing and export facilitation company for food and agricultural products originating from India.

Our services may include:

Sourcing products from approved suppliers
Coordinating samples, documentation, inspections, and logistics
Assisting with certifications and regulatory documentation
Facilitating export transactions and communication between parties
Anagh Foods does not manufacture products unless expressly stated in writing.

 
2. Relationship with Privacy Policy
All information shared by you is collected, processed, stored, and disclosed strictly in accordance with our Privacy Policy.

By using our services, you acknowledge and agree that:

Information collected is primarily business and contact information
Data is used for legitimate business, contractual, and compliance purposes
We do not sell or misuse business or personal data
 
3. Eligibility & Business Use
Our services are intended solely for businesses that:

Are legally permitted to import food products
Hold valid licenses, registrations, and approvals in their jurisdiction
By engaging with us, you confirm that you are acting in a commercial capacity and not as a consumer.

 
4. Accuracy of Information
You agree to provide accurate, complete, and up-to-date business and compliance information, including:

Import requirements and destination country regulations
Product specifications and approvals
Anagh Foods shall not be liable for delays, losses, or non-compliance arising from incorrect or incomplete information provided by you.

 
5. Quotations, Pricing & Commercial Terms
All quotations, prices, and product descriptions are indicative unless confirmed in writing.
Prices may change due to raw material costs, seasonality, regulatory changes, or exchange rate fluctuations.
Final commercial terms (Incoterms, payment terms, delivery schedules, specifications) shall be confirmed through a written agreement, proforma invoice, or contract.
 
6. Compliance & Regulatory Responsibility
The importer/buyer is solely responsible for compliance with laws and regulations of the destination market, including food safety, labeling, and customs requirements.
While Anagh Foods may assist with documentation and certifications, final regulatory responsibility rests with the buyer.
 
7. Samples, Approvals & Natural Variations
Samples are provided for evaluation purposes only.
Due to the natural nature of agricultural and food products, minor variations may occur between samples and commercial shipments.
Commercial production proceeds only after written approval.
 
8. Payments & Financial Terms
Payment terms shall be specified in the applicable invoice or agreement.
Delayed payments may result in suspension or cancellation of services.
All bank charges, duties, taxes, and import-related costs are borne by the buyer unless agreed otherwise.
 
9. Confidentiality & Data Protection
Both parties agree to maintain confidentiality of all non-public commercial, pricing, supplier, and business information exchanged.

Confidential information is protected in line with our Privacy Policy, applicable data protection laws, and reasonable security practices.

 
10. Intellectual Property
All website content, documents, logos, trademarks, and materials belong to Anagh Foods unless stated otherwise. Unauthorized use is prohibited.

 
11. Limitation of Liability
To the maximum extent permitted by law:

Anagh Foods shall not be liable for indirect, incidental, or consequential damages, including loss of profits, market access, or business opportunity.
Any liability shall be limited to the value of the specific service or transaction giving rise to the claim.
 
12. Force Majeure
Anagh Foods shall not be liable for delays or failure due to events beyond reasonable control, including:

Government actions, trade restrictions, or regulatory changes
Port congestion, strikes, logistics disruptions
Pandemics or global supply chain interruptions
 
13. Termination
We reserve the right to suspend or terminate engagement if:

Payment obligations are not met
Activities are unlawful or harm our business reputation
Termination does not affect accrued rights or obligations.

 
14. Governing Law & Jurisdiction
These Terms and the Privacy Policy shall be governed by the laws of India.
Courts located in India shall have exclusive jurisdiction.
